Adjoining Owner FAQ

I live next door to the person having the work done

Who pays your fees if I appoint a surveyor?

In almost all cases, the building owner (the person doing the work) pays. It is very rare for an adjoining owner to be asked to contribute.

Will the surveyor be impartial if my neighbour is paying?

Yes. Party wall surveyors are legally required to act impartially. Their role is to apply the Act fairly, not to represent one side over the other.

What if my neighbour starts work without serving a notice?

They may be acting unlawfully. You can seek professional advice, and in some cases a court injunction may be available to stop works until the correct process is followed.

How did you obtain my contact details?

Contact details are obtained through lawful and regulated sources such as public records or planning information. If you have concerns, we are happy to explain this in more detail.

My neighbour says they don't need a notice - how can I be sure?

The responsibility is on them to prove a notice is not required. Foundation depths and construction details are often unknown, so professional advice is strongly recommended where there is any doubt.
